Fair Use Policy
JSBCloud, a brand of ALTISCORE SAS, operates its own servers at the Equinix PA5 data centre in Paris. Most of our plans run on infrastructure that is shared: the same network link, the same hypervisor or the same hosting server hosts several customers at once.
This policy states precisely what we count, the threshold at which something happens, what exactly happens, and how you are told about it. It is deliberately factual: we announce no limit that we are unable to measure, and no measure that we are unable to apply.
It supplements the General Terms and Conditions and the Prohibited Activities page. The processing of your personal data is governed by the Privacy Policy.
Application over time
The limits introduced or tightened by this version apply to services ordered on or after its effective date. For services already running on that date, they apply only from the first renewal that follows, and the customers concerned are told by email before that date.
1. Purpose and scope
This policy applies to the following plans: shared web hosting, business email, VPS, game servers, GameBox pools and domain names.
Two regimes exist side by side, and it is important not to confuse them:
- measured limits, counted by our systems, which automatically trigger a specific effect, described in the articles below;
- human assessments, made by a member of our team after review, where the behaviour of a service degrades the operation of the shared infrastructure or the service given to other customers.
A human assessment is not a discretionary one: it rests on measurements that we pass on to you, it is notified to you in the form set out in article 13, and you may challenge it under articles 9 and 13.

Dedicated servers (bare metal) do not appear in this table: that range is not currently on sale. It will be added to this policy on the day it goes on sale.
Priority Support and the dedicated IP option do not appear there either: the first is governed by the General Terms and Conditions, the second is not currently on sale.
2. What we measure, and what we do not measure
What we measure
- The network traffic volume of every VPS, read from the hypervisor every five minutes, for the reports shown in your client area. For VPS whose plan states both a bandwidth and an included monthly volume, a second hourly reading feeds the counter for the period and triggers the bandwidth reduction set out in article 4.
- The processor and memory usage of every VPS, read every five minutes, for availability reporting and diagnosis. These readings are kept for 40 days. No threshold, no alert, no automatic throttling and no automatic sanction rests on this measurement.
- The operating state of the machines and the availability of the services: one reading every five minutes per VPS, and external probes every minute for the public status page.
- The quotas of your plan, at the moment you create a resource: site, mailbox, database, pool server, additional port, snapshot.
- The rate of repeatable technical actions started from your client area.
- The pause days used, where the Flexible Pause option is active, under the conditions set out in article 8.
What we do not measure
- The traffic volume of email plans, game servers and GameBox pools. The traffic of web hosting plans is read from the panel and shown for information only, with no cap and no automatic consequence, as article 5 states.
- The number of messages you send. We apply no automatic sending cap. Sending abuse is established through recipient complaints and through reports from anti-abuse and reputation organisations, under the conditions set out in article 13.
- The content hosted on your machines, your sites and your mailboxes. We carry out no general monitoring of content and we do not read your data, in keeping with our status as a hosting provider (hébergeur under French law). Three automated processes are exceptions, and you know about them: the anti-spam and antivirus filtering of email plans, active by default; the antivirus scan of attachments uploaded to a ticket; and the artificial intelligence assistants that you enable yourself, described in article 10 and in the Privacy Policy.
What is not measured is not thereby permitted. Prohibited uses remain prohibited; they are simply established on report or during a technical intervention, and not by an automatic detector. The applicable procedure is set out in article 13.
3. VPS network: bandwidth, included volume and period
Bandwidth
The network bandwidth of your VPS is the one shown on its plan page. It is set on each network interface of the machine at delivery. The bandwidth stated on a plan page is a maximum on a shared link.
Where a plan states no bandwidth, no rate limit is set on the interface: the actual throughput then depends on the load of the shared link, with no guarantee on our part.
Included monthly volume
Where the page of a VPS plan states both a bandwidth and a monthly volume of traffic, that volume is counted and enforced. We count the sum of the bytes in and out of all the network interfaces of the machine, with no distinction of direction or destination.
Terabytes are understood in the commercial sense used in networks: 1 TB means 1,000,000,000,000 bytes, and not 1,099,511,627,776.
Where the plan page states no monthly volume, no volume cap is applied and bandwidth is never reduced on that ground. Where it states a monthly volume without a reduced bandwidth, no reduction is applied when the volume is exceeded.
Counting period
The counting period is a rolling window of 30 days, starting from the delivery of your service and renewing every 30 days thereafter. It is independent of your billing cycle and is reset neither by a renewal nor by a change of plan: a quarterly subscription runs through three successive 30-day windows, each with its own included volume.
At the end of each window, the counter returns to zero automatically. The counter does not advance and the period does not run while a service is suspended.
Because this window does not coincide with your billing cycle, a bandwidth reduction may continue into the start of a period you have just paid for. If that happens, write to support: the days concerned are credited to you pro rata.
Retention of the counter
Consumption is counted and kept by JSBCloud, not by your machine. Reinstalling the operating system resets the hypervisor counters, but does not reset your consumption for the current period.
What you see
Where the plan includes a volume, the details page of your service shows at all times: the nominal bandwidth, the applicable reduced bandwidth, the included volume, the volume used, the percentage reached, the start and end dates of the current period, and the bandwidth reduction status.
4. Exceeding the included volume

Points of detail, so that there is no ambiguity:
- No overage charge is applied. Exceeding the included volume costs nothing.
- No suspension of service occurs on this ground.
- No warning is sent. The bandwidth reduction is applied without prior notice as soon as the volume is reached. That is precisely why the counter is shown at all times in your client area: it is for you to keep track of it.
- The reduction cannot be lifted early. It lasts until the 30-day period renews, and no step on your part, no correction of your usage and no request to support can shorten it. Restoration is automatic. If it has not happened by the start of the following period, report it by ticket: we restore it without delay.
- The bandwidth reduction is not a sanction. It opens no case, counts towards no warning and has no consequence for your account.
5. Shared web hosting
Shared web hosting is subject to firm quotas, applied by the hosting panel. They are set out below.

Where you hold several web hosting plans, the quotas of all your plans that have not been terminated are added together and applied to your account as a whole. The mailbox and alias quotas of a business email plan are added to them, both being served by the same panel. Where one of your plans states an unlimited quota, that quota becomes unlimited for the account as a whole.
Scheduled tasks
Scheduled tasks are limited to calling an HTTP address, with a minimum interval of one minute between two runs. Running system commands is not offered on shared hosting.
Traffic
We neither count nor cap the traffic volume of web hosting plans. The traffic used is read from the panel and shown in your client area for information only, with no automatic consequence.
Where the page of a plan expressly states a traffic quota, that quota applies, and it is enforced by the hosting panel. Failing such a statement, no traffic cap is applied.
What happens when a quota is reached
Creation of the resource concerned is refused, with an explicit message in the interface. Nothing is deleted, no bandwidth is reduced and no service is suspended on this ground. A request to retain more backups than the maximum of your plan is refused, and not lowered silently. The storage quota of a mailbox follows a different rule, set out in article 6.
To go beyond a quota, you have to change plan: see article 15.
6. Business email

Space is counted per mailbox, and not for the domain as a whole. Where you request, for a mailbox, a quota higher than the maximum of your plan, the value used is that of the plan: the creation or the change goes through, with the quota of the plan, and the value actually applied is the one shown on the mailbox details page.
Anti-spam and antivirus filtering are active by default on email plans.
Message size
A message composed from the webmail cannot exceed 25 MB of attachments, checked file by file and cumulatively across the draft.
Sending volume
We apply no automatic cap on the number of messages sent, whether per hour, per day or by number of recipients.
Mass sending of unsolicited messages remains prohibited nonetheless, as stated on the Prohibited Activities page. It is established on report: a complaint from a recipient, the blacklisting of an IP address or of a domain, an alert from a third party or from our network provider. The applicable procedure is the one set out in article 13.
Delivery log
The delivery log of your messages goes back 2 days by default and 14 days at most, at a rate of 12 searches per minute and per account.
7. Game servers and GameBox pools
Game servers
The memory, the disk space and the processor share are those of your plan, set as limits on the game panel at delivery. Three feature quotas are added to them, also set by the plan: number of databases (0 by default), number of network ports (1 by default) and number of backups (0 by default).
Backups of a game server are triggered by you, from the panel, within that quota. No automatic backup is set at delivery.
GameBox pools
A GameBox pool has a maximum number of servers, a total of vCPU, a total of memory and a total of disk space, together with minimums per server (by default 1 vCPU, 512 MB of memory and 2 GB of disk). These values appear on the plan page.
Creating or resizing a server is refused if it would cross one of these caps, with an explicit message. The number of servers in a pool is never unlimited.
Shutdown of idle servers
The automatic shutdown of an empty game server is a convenience option that you enable yourself, choosing its delay. It is never a sanction, and it is never applied without your request.
How it works: the number of players is read every five minutes using the protocol of the game concerned. The shutdown is triggered once the server has stayed empty for the number of consecutive minutes you have chosen. A server that cannot be reached is never treated as empty, and the counter restarts from zero after a shutdown. Not every game has a player count probe: the option therefore cannot be offered on all of them.
8. VPS: resources, snapshots, backups, ISO images and Flexible Pause
Allocated resources
The number of cores, the memory and the disk space are those of your plan, set on the machine at delivery. They do not vary during the period: only a change of plan alters them.
Snapshots
The number of simultaneous snapshots allowed is that of your plan. Where the plan provides for none, the feature is not available. Beyond the number allowed, creation is refused with an explicit message. A disk in RAW format does not support snapshots; the refusal is then explicit and a conversion is offered to you.
Automatic backup
Automatic backup of a VPS is a paid option, available on the plans that offer it. It is never included: without this option, no backup is taken.
When it is active:
- the run is daily, from 6:00 am Paris time. Machines are processed one after another: the actual time of your backup therefore depends on the number of machines to be processed that day;
- the machine is shut down for the whole duration of the archive, then powered back on automatically by the hypervisor, with one to two minutes of boot time. This daily interruption is inherent in the backup method chosen, which guarantees the consistency of the archive. It is an essential feature of the option: it is described here before any subscription, and the option is enabled only at your request;
- the number of archives kept is that of your plan, 7 by default. Beyond that, the oldest one is deleted;
- the archives are written on the same infrastructure as your machine and are not replicated to another site. The option protects against a handling error or a software failure, not against the loss of the hosting site;
- in the event of a failure, no further attempt takes place the same day: the next automatic run is the following day's. No email tells you today that a backup has failed: it is the list of available archives in your client area that determines what has actually been saved;
- restoration is triggered by you, from your client area. It shuts the machine down, restores the archive and then restarts it.
Responsibility for backing up your data lies with you, in accordance with the General Terms and Conditions. We carry out the backups of the option above with due care, under the technical conditions described. Given the nature of computing, the success of a restore cannot be guaranteed in every case. This limitation applies neither in the event of gross negligence nor in the event of wilful misconduct, and it deprives a consumer of no right to compensation.
Uploaded ISO images
The ISO images you upload are kept for 7 days from the day they are uploaded, then deleted automatically. An email and a notification in your client area warn you around 24 hours before deletion. An image in use for an installation is never deleted.
Flexible Pause
Flexible Pause is a paid option that can be enabled only when the service is ordered. It lets you pause your VPS or your game server without terminating it.
It opens a quota of pause days per billing cycle, equal to 20 per cent of the days in the cycle: 6 days for a monthly cycle, 18 for a quarterly cycle, 36 for a half-yearly cycle, 73 for a yearly cycle and 146 for a two-yearly cycle. The days used are counted and shown on the service details page.
Once the quota is used up, the service resumes automatically, at the latest one hour after the quota runs out. This is not a sanction and it opens no case.
9. Processor and shared resources
Shared and virtualised services run on infrastructure that is shared. The resources stated are those allocated to your service.
We read the processor and memory usage of your VPS for reporting and diagnosis, as article 2 states. There is in our systems no threshold, no alert and no automatic processor throttling, and no automatic sanction rests on this reading.
Where, on the other hand, the behaviour of a service degrades the operation of the shared infrastructure or the quality of service of other customers, we may intervene. That intervention is decided by a person, after review, and we contact you before acting, except where the integrity or the security of the infrastructure calls for immediate action.
The finding rests on objective elements: sustained load measured by the hypervisor over an extended period, a measured degradation of latency or of disk access on the node, or the saturation of a shared link. These measurements are passed on to you, and you are given time to respond and to put things right before any suspension, save where security makes it urgent.
The possible measures, in this order: contact and technical advice, the proposal of a plan suited to your usage, and, as a last resort, suspension of the service under the conditions set out in the General Terms and Conditions. A measure taken on this basis is challenged under article 13; a consumer may take the disagreement to the consumer mediator CM2C, under the conditions set out in article 18, and then to the courts.
10. Artificial intelligence assistants
Included credits and purchased credits
Included artificial intelligence credits come with certain plans only: web hosting, game servers, GameBox pools and email. The included amount appears on the plan page.
- The monthly allowance is topped back up on the 1st of each month, and not on the anniversary date of your service.
- Unused monthly credits do not carry over: the new allowance replaces the previous balance.
- Credits bought as a pack are permanent and do not expire.
- Consumption draws first on the monthly allowance, then on purchased credits.
Permitted negative balance
An action already under way may take your balance down to minus 10 credits, so that it is not cut off midway. This advance is deducted from your next allowance. Starting a new action, on the other hand, requires a strictly positive balance.
Limits per request
Each request is bounded in cost and in length. These bounds are set out by the interface, and the assistant stops cleanly, offering to continue rather than spending without your agreement.

Availability
The included monthly allowance is provided in addition to our services, with no availability guarantee. Assistants may be limited or temporarily suspended, in particular where the model provider is unavailable.
Purchased credits follow a different regime: they are paid for, and our internal spending cap cannot be held against you. If an assistant remains unavailable for more than 30 consecutive days, the purchased credits you have not used are refunded to you on request.
Access to the assistants may also be withdrawn from an account, by decision of a member of our team, where the use made of them is contrary to this policy or to the Prohibited Activities page. That measure is notified to you and is challenged under article 13. Where it is taken, the purchased credits you have not used are returned to you on the terms of article 13; only the unused free monthly allowance is lost.
The content produced by our assistants is generated automatically, is not checked by our teams and is your responsibility as soon as you publish it or send it.
The data you submit to an assistant is passed to our model provider for the time of the processing. Its identity, the country of processing, the basis for the transfer and the way your consent is obtained are set out in the Privacy Policy.
11. Rate of technical actions
Repeatable technical actions started from your client area are limited in rate, in order to protect the shared infrastructure and shared resources, such as the ports available on a node.

Where one of these limits is reached, the interface tells you at the moment of the refusal. These limits lift by themselves, at the end of the window shown in the table, without any action on our part and without any step on yours.
12. Temporary IP address blocks
Repeated authentication or registration attempts lead to an automatic and temporary block of the IP address concerned, lasting longer as the attempts persist.

None of these blocks is permanent. A permanent block of an IP address or of an account can only result from a human decision.
These blocks are automatic. If one of them stops you reaching your client area, for instance because you share your address with other people, write to [email protected] from another connection stating the address concerned: a member of our team reviews the block and can lift it.
These blocks concern access to our sites and interfaces, including the client area. They do not concern connections to the services you host, for which you remain solely responsible, with the single exception of the contact form of a site published with Altis Studio, whose rate is shown in article 11.
13. Repeated excesses, reports and sanctions
What is not a sanction
The bandwidth reduction described in article 4, the quota refusals described in articles 5 to 8 and the automatic resumption once the Flexible Pause quota is used up are not sanctions. They open no case and have no further consequence.
Manifestly unlawful content
A report concerning manifestly unlawful content is dealt with immediately, outside the scale set out below: the content is made inaccessible or the service suspended as soon as we have knowledge of it, in accordance with article 6 of the French Act on confidence in the digital economy and with Regulation (EU) 2022/2065.
Reports concerning the activities referred to in article 6 of that Act are promptly brought to the attention of the competent public authorities.
Reporting content
Anyone may report to us content they consider unlawful by writing to [email protected]. For the report to be actionable, it must state: the exact address of the content or the IP address concerned, the nature of the unlawfulness alleged, an account of the facts and of their date, the contact details of the reporting party, and a statement of good faith as to the accuracy of the information provided.
We acknowledge receipt without delay, we examine the report, and we notify our reasoned decision both to the reporting party and to the customer concerned. Where automated means have been used to detect or handle the content, the notification says so.
Abuse reports
The scale below applies only to abuse that does not amount to manifestly unlawful content: spam, port scanning, brute force, resource abuse, harm to the reputation of addresses.
Reports sent automatically by our network provider are recorded and attached to the service concerned, manually where necessary when the service has no IP address of its own: it is those reports that feed the counter below. Reports sent by email to [email protected] are handled by a member of our team, who decides what follows case by case.
Each report is verified before being counted. A report found to be unfounded is not counted; if it had been, it is removed from the counter. The date, the nature of the abuse and the technical evidence behind it are passed on to you at the same time as the warning, so that you can respond to it properly.
The warning counter is kept per service, and not per account. Several reports concerning the same IP address within a window of 24 hours count as one only.

Points to know beforehand, and not afterwards:
- Reactivating a suspended service does not reset the counter. The next report is counted as the fourth.
- Closing an abuse case resets the counter of the service to zero. Closing is always decided by a person and recorded. A case left for twelve months with no new report counted is closed.
- The suspension at the third step is automatic. You may ask for it to be reviewed immediately through the ticket opened on that occasion: if the report turns out to be unfounded, the service is restored, the report is removed from the counter, and the period of suspension is credited to you pro rata.
- A report concerning a service that is already suspended or already terminated is recorded as evidence, but does not increment the counter.
- No termination is automatic: it is always decided by a person.
- We keep a timestamped record of each report, of each warning sent and of each measure taken, for evidential purposes.
What is refunded to you on termination
Where a service is terminated under this policy:
- the fraction of the price corresponding to the period not used is refunded to you pro rata, including where the current period had already started;
- periods paid for and not started are refunded to you in full;
- purchased credits and the prepaid balance of your account are returned to you; only the unused free monthly allowance is lost;
- the return calls for no step on your part, other than giving us your bank details where the means of payment used for the order is no longer available. It is made of our own motion, within thirty days of the effective date of the termination;
- the only amount that may be withheld from those sums is the cost of handling an abuse, on the terms set out in the following paragraph. No other amount is withheld or forfeited.
Cost of handling an abuse
Where the handling of an abuse attributable to you has caused JSBCloud to incur costs, those costs are set off against the sums to be returned to you: the fraction not used, the prepaid balance and purchased credits. That set-off follows the rules below, none of which is optional.
- Actual costs, and nothing else. Only the costs actually incurred are charged: the time spent by our team, the external costs and the third-party fees actually borne. The time spent is valued at the published hourly rate of 70 euros excluding tax, that is 84 euros including all taxes at the French rate of 20 percent, the amount applied to a consumer customer resident in France, the tax of their own country applying if they reside elsewhere in the European Union, and counted in units of fifteen minutes, each unit started being counted in full. No amount is set unilaterally, nor as a lump sum.
- A detailed statement. A statement is given to you, item by item, with the material it rests on. It is notified to you before any set-off.
- Fifteen days to challenge. You have fifteen days from that notification to challenge the statement at [email protected]. We reply with a reasoned decision within 15 days. The set-off is made only at the end of the period for challenge or, where the statement is challenged, after that reply. A challenge delays only the fraction challenged: the remainder of the sums is returned to you within the thirty-day period stated above.
- Cap. For a consumer customer, the set-off may not exceed 150 euros including all taxes per case, in any circumstances. For a business customer, the actual costs are due, expressed excluding tax and with no cap.
- Where the costs exceed the sums owed to you. The balance is then the subject of an ordinary invoice, payable on the usual terms of the General Terms and Conditions, and not of a withholding from other sums.
- Reciprocity. Where JSBCloud is in serious breach of its own obligations, you are entitled to equivalent compensation, on the same rules of evidence: costs actually incurred, a detailed statement, and a challenge open in the same form and within the same time limits. That compensation deprives you of none of the remedies provided for by the General Terms and Conditions.
These rules of return and of set-off are the ones applied by the General Terms and Conditions in the event of termination for breach, and they apply notwithstanding any provision to the contrary.
Immediate measures
We may suspend or limit a service immediately, without going through the scale above, in the event of harm to the integrity or the security of our infrastructure or of that of third parties, or on an order from a competent authority. Manifestly unlawful content falls under the regime described above.
Notification of a measure and challenge
Any measure restricting your service is notified to you together with: the facts found and their date, the contractual or legal basis relied on, a statement of any automated processing that led to the decision, the scope and the duration of the measure, and the means of redress open to you.
You may challenge it by replying to the ticket opened on your account, attaching any useful evidence. A member of our team reviews the file and sends you a reasoned decision through that same channel.
If you are a consumer and your written complaint sent to [email protected] has not succeeded, you may refer the matter free of charge to the consumer mediator CM2C, on the terms recalled in article 18. You retain in any event the right to go to court.
14. How you are told
We prefer to state clearly in which cases an email is sent, and in which cases it is not.

Emails are sent to the address on your account. It is for you to keep it up to date and to make sure that our messages reach you.
15. Exceptions and specific needs
Volumes, bandwidth and quotas are set by the plan, and not by your account. There is therefore no individual exception that we can enable on request, and no early lifting of a bandwidth reduction.
The figures shown on the page of a plan form an integral part of this policy, and any change to those figures follows the regime of article 17. The characteristics displayed on the day of your order can be relied on against us, and the burden of proving their content lies with us.
A specific need is handled in one way only: by a change of plan, or by a bespoke plan agreed in writing before the planned intensive usage. If you expect a traffic peak, a one-off event or a rise in load, write to support beforehand, and not after the fact.
16. What this policy does not cover
- Service availability, commitments on timescales and compensation are governed by the General Terms and Conditions. This policy sets out no availability commitment.
- Prohibited activities are listed on the Prohibited Activities page, which also describes the categories of prohibited content and how abuse is to be reported.
- Backing up your data remains your responsibility, under the conditions recalled in article 8 and in the General Terms and Conditions.
- The processing of your personal data, the retention periods and your rights of access, rectification, erasure and objection are governed by the Privacy Policy, which this policy does not duplicate.
17. Changes to this policy
JSBCloud may change this policy. Each publication creates a numbered version, which is kept. The version in force is the one published on this page, as at the date shown below.
Every creation of a limit and every tightening of an existing limit, including the figures shown on the page of a plan, are announced by email to the customers concerned, with no judgement on our part as to whether the change is significant.
For consumer customers, a change that creates or tightens a limit, or that alters a characteristic of the service, applies only from the following renewal. A customer who refuses it may terminate free of charge before that date and obtains a pro rata refund of the period not yet run.
For business customers, such a change takes effect at the earliest 30 days after that information is given, unless it follows from a legal obligation or from a security requirement.

Means devoted to fighting unlawful activities
A dedicated reporting address, monitored by our team; immediate handling of manifestly unlawful content, outside any warning scale; prompt notification to the competent public authorities of the activities referred to in article 6 of the French Act on confidence in the digital economy; and a timestamped record of every report, every warning and every measure taken.
Mediation and jurisdiction
If you are a consumer, you have the right to refer a dispute free of charge to a consumer mediator (médiateur de la consommation), in accordance with articles L612-1 and following of the French Consumer Code. That referral requires a prior written complaint sent to [email protected], to which we endeavour to reply within 15 days, and it is made within one year of that complaint.
The competent consumer mediator is CM2C, Centre de la médiation de la consommation de conciliateurs de justice, of which JSBCloud is a member. Its contact details, published below in accordance with article L616-1 of the French Consumer Code, also appear in article 37 of the General Terms and Conditions.
In accordance with the provisions of the French Consumer Code on the process of mediation of consumer disputes, after you have contacted us and failing a reply that satisfies you, you have the possibility of referring the matter free of charge to a consumer mediation procedure with:

Recourse to mediation is optional and deprives you of no legal remedy: you retain in any event the right to go to court.
If you are a consumer residing in another Member State of the European Union, the choice of French law does not deprive you of the protection of the mandatory provisions of your country of residence, and you may bring proceedings, at your choice, before the courts of your place of residence or before those of the registered office of ALTISCORE SAS.
Language
This policy is published in French and in English. Each version is authoritative for the customer who contracted in that language. In the event of a divergence, the interpretation most favourable to the consumer prevails.
